Public Sector Information: Identification of potential exclusive agreements
Directive 2003/98/EC on the re-use of public sector information (PSI) prohibits, as a rule, exclusive arrangements (EAs). Since re-users of PSI voicing complaints the European Commission launched several studies to investigate if exclusive arrangements are still in force in the Member States
such arrangements in a large number of Member States.
Italy is one of the larger countries and economies in Europe, and potential for PSI re-use is significant. Performed under the support of the Presidency of the Council of Ministers, the study collects relevant information from hundreds of public sector bodies allowing re-use of PSI as well as market players re-using this information on the potential existence of EAs in the light of article 11 of the PSI Directive. Based on appropriate legal review of the agreements in place, the study provides the EC with details and analysis of a list of potential EAs.
