Study: 'Assessment of the current legal situation and the possible impact of Posting of Workers Directive on local and regional authorities'

Committee of the Regions

  • Start Date: April 2012

  • Status: Complete

The analysis has issued an opinion on the Directive concerning the enforcement of the provisions applicable to the posting of workers in the framework of the provision of services. Since the current Directive (96/71/EC) has been the object of some criticism, the European Commission proposed a revision in March 2012 (COM(2012) 131 Final) in order to improve, enhance and reinforce its effectiveness and applicability by facilitating the cross-border provision of services and improving the climate of fair competition. The main aim of the study was to seek insight into how local and regional authorities (LRAs) may be affected by the proposed changes and simultaneously, to assess in what way LRAs could benefit from the new provisions by identifying positive and negatives aspects of the new proposal.

The report of the study is available here.
